Ratio Decidendi

The court found that the applicants had explained the delay in filing the appeal and that the delay was not inordinate. Recognizing the right to appeal, the court exercised its discretion to extend the time for filing the appeal by 15 days from the date of the ruling. The court also found it reasonable to grant a stay of execution pending the hearing and determination of the appeal, provided that the applicants furnish a bank guarantee of Kshs. 1 million as security, valid for one year. Costs were ordered to abide the outcome of the appeal.
