Even if negotiations for settlement had occurred, they had conclusively ended in September 2009, after which the plaintiff took no steps to prosecute its application. The court held that there was no credible or sufficient explanation for this prolonged inaction. Accordingly, the court dismissed the plaintiff's notice of motion dated 27th June 2001 for want of prosecution, with costs to the defendants.
