The application was filed after the lapse of the period sought, and no payment had been made by the applicant in the interim. The court agreed with the respondent that the applicant was not diligent and that the application was intended to delay the course of justice, amounting to an abuse of the court's process. Additionally, the prayers for stay of execution had been overtaken by events and were therefore spent.
