The court held that it has jurisdiction to determine the application because the challenge to the arbitrator's jurisdiction was filed before the final arbitral award was published and is yet to be determined. However, the application to admit new evidence (the letter from the Insurance Regulatory Authority) and to amend pleadings post-award is without merit. The letter did not exist at the time of the arbitral proceedings and could have been procured with reasonable diligence. Allowing its admission at this stage would amount to the court usurping the arbitrator's role and reopening issues already conclusively determined by the arbitral tribunal, contrary to the finality principle in...
