Ratio Decidendi

The trial court erred in imposing a five-year sentence for defilement where the law under section 8(2) of the Sexual Offences Act prescribes a mandatory sentence of life imprisonment for victims under eleven years. The Supreme Court's decision in Muruatetu, which appeared to grant discretion in sentencing where mandatory minimums exist, was clarified to apply only to murder cases and not to sexual offences. Therefore, the trial court had no discretion to impose a lesser sentence, and the sentence imposed was both improper and illegal. The High Court set aside the five-year sentence and substituted it with a sentence of life imprisonment as mandated by law.
