The High Court held that the trial magistrate acted outside its jurisdiction by determining an alleged violation of the right to a fair trial under Article 50, as the Magistrates' Courts Act only confers jurisdiction to address violations of rights under Article 25(a) and (b), not (c). The court further found that Section 89(5) of the Criminal Procedure Code was misapplied, as it only permits dismissal of charges before plea is taken if no offence is disclosed, which was not the case here. The prosecution's duty of disclosure is ongoing, but the drastic remedy of dismissing charges for non-disclosure was premature; the trial court should have summoned the Parliamentary Service Commission...
