Ratio Decidendi

The court found that the respondent failed to comply with the mandatory statutory procedure for redundancy under section 40 of the Employment Act. The claimant was not given proper notice, the Labour Officer was not notified, there was no evidence of a fair selection process, and terminal dues were not paid. As a result, the termination was both unfair and unlawful. The court awarded the claimant one month salary in lieu of notice, six months' salary as compensation for unfair termination, and service pay for two years, declining severance pay as the redundancy was not properly executed. The court also awarded costs and interest, less statutory deductions.
