Upon re-evaluation of the evidence, the appellate court determined that Musiani (Mushangi Asambwa) was the original allottee, as supported by SFT records, land registry documents, and contemporaneous correspondence. The respondents' repayment of the SFT loan did not confer proprietary rights, as there was no agreement or trust between Musiani and the respondents, nor was any encumbrance registered to secure their interest.
