Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion for Execution Before Taxation of Costs

  1. 1 Whether the respondent is in default of the terms stipulated under the consent order.
  2. 2 Whether the applicants should be permitted to proceed with execution before taxation of costs.

Ratio Decidendi

The court found that while the respondent had previously been indulged for late payments, the September 2018 instalment was not paid as and when due, and the cheques were issued after the stipulated date in the consent order. The applicants were within their rights to decline the late cheques, having already warned the respondent that no further delay would be tolerated. The respondent's failure to comply strictly with the payment schedule constituted a default under the consent order, entitling the applicants to proceed with execution before taxation of costs. The court therefore allowed the application as prayed.
