Ratio Decidendi

The appeal was dismissed because the challenge to the order of 29th May, 2019 was filed out of time and was therefore incompetent. The subsequent order of 2nd July, 2019, being based on the earlier order, could not stand independently. However, the High Court recognized that the trial court acted unprocedurally by issuing orders in a withdrawn suit without formal reinstatement. Exercising its appellate powers, the High Court reinstated the suit to ensure the matter involving the interests of a minor could be properly adjudicated, but set aside the warrant of arrest issued against the appellant. No order as to costs was made due to the nature of the case.
