Procedural Posture

Family Appeal / Ruling on Execution Application

  1. 1 Whether the High Court has jurisdiction to execute a decree issued by the lower court in a children’s matter.
  2. 2 Whether the applicant is entitled to execution by attachment and sale of the respondent's immovable property for arrears in child maintenance.
  3. 3 Whether the application for execution should be granted in the circumstances.

Ratio Decidendi

The High Court determined that, although it had previously handled certain aspects of execution (such as salary attachment for maintenance ordered on appeal), the substantive decree sought to be executed in this application originated from the lower (children’s) court. Therefore, the proper forum for seeking execution by attachment and sale of immovable property is the court that issued the original decree. The High Court lacks jurisdiction to execute the lower court's decree in this context, and the applicant must move the lower court for such orders. Consequently, the application was dismissed.

Court Disposition

Orders
