Procedural Posture

Criminal Appeal / Sentence Appeal; Ruling on Sentence Only

  1. 1 Whether the sentence of twenty years imprisonment for defilement was lawful and appropriate in the circumstances.
  2. 2 Whether the trial court exercised its discretion in sentencing or merely imposed the statutory minimum.
  3. 3 Whether the appellant's mitigation as a first offender and breadwinner warranted a reduction of sentence.

Ratio Decidendi

The High Court found that while the trial court imposed the mandatory minimum sentence of twenty years for defilement, it did not exercise its discretion in considering the circumstances and mitigation. The appellant, though a first offender and breadwinner, committed a grave breach of trust by defiling his 12-year-old stepdaughter and traumatizing both her and her mother. The court acknowledged the lawfulness of the sentence but determined that, in the interests of justice and considering the mitigation, the sentence should be reduced. The court set aside the twenty-year sentence and substituted it with fifteen years imprisonment, to be calculated from the date of arrest.

Court Disposition

Sentence reduced; appeal against sentence partially allowed.
