The High Court found that the respondent's suit was filed within the statutory limitation period because the last day for filing, 7th March 2021, was a Sunday, and the suit was filed on the next working day, 8th March 2021, in accordance with Order 50 Rule 2 of the Civil Procedure Rules and section 57(b) of the Interpretation and General Provisions Act. The trial court correctly applied the law on computation of time and did not err in dismissing the preliminary objection or in declining to strike out the suit as time-barred. The appellate court found no basis to interfere with the trial court's exercise of discretion or findings, and upheld the trial court's ruling.
