Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the court can grant a stay of execution where the impugned order is a dismissal of an application for injunction with costs.
  2. 2 Whether the Applicants have met the threshold for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.

Ratio Decidendi

The court found that the ruling delivered on 12th July 2019 merely dismissed the Applicants' application for injunction with costs and did not grant any positive order capable of execution. As such, there was no positive order to stay, save for costs. The court held that it has no jurisdiction to grant a stay of execution in respect of a negative order. The application for stay of execution therefore lacked merit and was dismissed with costs to the Respondents.
