Ratio Decidendi

The court found that, following the Supreme Court decision in R v Karisa Chengo and 2 Others, only the High Court has jurisdiction to hear and determine criminal appeals from the Magistrates’ Courts. Judges appointed to the Environment and Land Court do not have jurisdiction over criminal appeals. As the applicant’s initial appeal was heard by a judge of the Environment and Land Court, the proceedings were a nullity. Consequently, the applicant was entitled to file his appeal out of time, as the previous proceedings were void ab initio due to lack of jurisdiction.
