Ratio Decidendi

The court found that the respondent's actions in terminating the claimant's employment were unfair, unlawful, and actuated by malice. The respondent failed to provide valid or fair reasons for the retrenchment, did not follow due process, and subjected the claimant to abnormal transfers and unrealistic targets. The court held that the termination did not comply with the requirements of Section 45 of the Employment Act, 2007, as the employer did not act in accordance with justice and equity. The claimant was therefore entitled to compensation for unfair termination, notice pay, and punitive damages. The respondent was ordered to bear the costs of the suit.
