Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of execution of the judgment pending appeal.
  2. 2 Whether the application for stay was made without unreasonable delay.
  3. 3 Whether the applicant has demonstrated willingness to provide security for the due performance of the decree.

Ratio Decidendi

The court found that the applicant satisfied the requirements for a stay of execution under Order 42 Rule 6(2) of the Civil Procedure Rules. The application was made without unreasonable delay, and the applicant expressed willingness to provide security as ordered by the court. The court determined that, to prevent the appeal from being rendered nugatory, a conditional stay should be granted. The stay of execution was allowed on the condition that the decretal sum be deposited in an interest-earning account held jointly by counsel for both parties within 30 days, failing which execution would proceed.
