The Court of Appeal held that it lacked jurisdiction to entertain an appeal from the High Court in matters prosecuted under the Land Disputes Tribunal Act, as the Act does not provide for such appeals. The appellate jurisdiction of the Court of Appeal is statutory and must be expressly conferred by law. Furthermore, even if the appeal were competent, the Tribunal and Appeals Committee had no jurisdiction to adjudicate disputes relating to ownership or title to land, as their mandate is limited to issues of boundaries, occupation, or trespass.
