There was no evidence of attempts to fix the suit for hearing or correspondence regarding the alleged missing file. The court held that reinstating the suit would be prejudicial to the Defendant, given the age of the dispute and the financial hardship suffered. The Plaintiff's application was therefore dismissed for lack of merit.
