The High Court found that although the charge sheet could have been better drafted, the appellant was not prejudiced as he understood the nature of the charge and fully participated in the trial, including cross-examining witnesses and presenting a defence. The evidence established that the appellant, who was well known to the complainant and her brother, took the complainant to his house, where she was found locked inside, and medical evidence confirmed at least an attempt at defilement. The trial court was entitled to convict for attempted defilement as a cognate and minor offence to defilement under section 179 of the Criminal Procedure Code.
