Ratio Decidendi

The court held that it lacked jurisdiction to grant an injunction pending appeal because the appeal was to the Court of Appeal, not to itself, and thus it was functus officio. Regarding the stay of execution, the court found that the judgment dismissing the Applicant’s suit was a negative order incapable of execution, and therefore not subject to a stay. Even if the order could be stayed, the Applicant failed to satisfy all three mandatory conditions under Order 42 Rule 6 of the Civil Procedure Rules, as he did not demonstrate substantial loss, nor did he offer security for costs. Consequently, the application for both injunction and stay of execution was dismissed for lack of merit.
