The Court of Appeal held that once the statutory power of sale under an English mortgage has been exercised and the property transferred to a bona fide purchaser, the mortgagor's equity of redemption is extinguished. Section 69B(2) of the Transfer of Property Act, 1882, precludes any challenge to the purchaser's title on grounds of irregularity or improper exercise of the power of sale; the mortgagor's sole remedy is in damages against the mortgagee. The High Court erred in granting a temporary injunction restraining the Bank and the appellant from dealing with the property, as the borrower's claim, even if true, could not entitle him to such relief.
