Procedural Posture

Stay Application / Ruling on Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the court should grant a stay of proceedings (specifically taxation of costs) pending the hearing and determination of Civil Appeal No. 30 of 2011.
  2. 2 Whether the Plaintiffs have satisfied the conditions for stay of execution or proceedings under Order 42 Rule 6 of the Civil Procedure Rules.

Ratio Decidendi

The court found that taxation proceedings are capable of being stayed as they are part of execution proceedings post-judgment. However, the Plaintiffs failed to demonstrate that they would suffer substantial loss if the stay was not granted, as taxation only ascertains the amount payable and does not itself constitute execution. Furthermore, the Plaintiffs did not show willingness to deposit security for costs, nor did they provide evidence that the Defendants would be unable to repay the costs if the appeal succeeded. As the Plaintiffs did not satisfy the conditions under Order 42 Rule 6(2) of the Civil Procedure Rules, the application for stay of proceedings was dismissed.
