The court found that while the application for leave to appeal out of time was filed approximately two months outside the statutory period, the delay was not so inordinate as to be incapable of remedy, particularly as the applicant only became aware of the judgment upon commencement of execution proceedings. The court considered the grounds of appeal to be arguable and determined that it would be in the interest of justice to allow the applicant an opportunity to pursue the appeal.
