The High Court found that the trial court properly relied on comparable authorities in assessing the quantum of damages and did not apply wrong principles or consider irrelevant factors. The appellate court reiterated that interference with an award is only justified where the award is manifestly excessive or inadequate, or where the trial court misapplied the law. In this case, the award of Kshs 800,000 in general damages and Kshs 3,850 in special damages was supported by evidence and precedent. The appeal was therefore dismissed for lack of merit, and the trial court's judgment was upheld in full.
