  2. 2 Whether the plaintiff is entitled to a refund of purchase monies paid for the suit land.

Ratio Decidendi

The court found that the plaintiff failed to prove he was a bonafide purchaser for value without notice. The 2nd-4th defendants, who purported to sell the land, did not have the authority of the 1st defendant to dispose of the property or receive monies on its behalf. No evidence was produced of the 1st defendant's constitution, list of members, or resolutions authorizing the sale. The plaintiff did not pay the purchase price into the 1st defendant's official account, and the 2nd-4th defendants could not demonstrate that the funds were used for the 1st defendant's purposes. As such, the sale agreement was null and void for want of capacity, and the plaintiff could not acquire good title....

Court Disposition

Plaintiff's claim for declaration of ownership declined; 2nd-4th defendants ordered to refund purchase price; costs awarded against 2nd-4th defendants.

Orders
