The court found that the applicant failed to satisfy the threshold for grant of stay pending appeal as set out in Order 42 Rule 6(2) of the Civil Procedure Rules. The applicant did not attach a Memorandum of Appeal to demonstrate sufficient cause, nor did they establish that substantial loss would result if stay was not granted. The alleged substantial loss, being a change in environment for the minor, was not considered sufficient. Furthermore, the applicant did not prove that granting custody to the biological mother would be contrary to the best interests of the child. The application was therefore found to be without merit and dismissed.
