The Plaintiffs' attempt to distinguish the present suit on the basis of different prayers and procedure (originating summons versus plaint) was rejected, as the court held that the doctrine of res judicata applies to all issues that were or could have been raised in the former suit. The Plaintiffs had not sought to set aside or appeal the consent judgment, and the reliefs now sought could and should have been addressed in the earlier proceedings.
