Procedural Posture

Resentencing Application / Judgment

  1. 1 Whether the mandatory death sentence for robbery with violence is unconstitutional in light of the Supreme Court decision in Muruatetu.
  2. 2 What is the appropriate sentence for the petitioner considering the aggravating and mitigating factors.

Ratio Decidendi

The court found that the mandatory death sentence for robbery with violence is unconstitutional, and that sentencing should be individualized, taking into account both aggravating and mitigating factors. In this case, while the petitioner used a dangerous weapon and inflicted injuries, he has already served 14 years in prison, demonstrated remorse, and shown evidence of reformation. The court determined that the time already served is sufficient punishment, and therefore resentenced the petitioner to the period already served, ordering his immediate release unless otherwise lawfully held.

Court Disposition

petition allowed in part; petitioner resentenced to time served and released

Orders

  • The petitioner is sentenced to the period already served.
  • The petitioner is to be released from prison forthwith unless otherwise lawfully held.
