Ratio Decidendi

The court found that the cause of action arose on 20th December 2000 and, under Section 4(2) of the Limitation of Actions Act, any action founded on tort must be brought within three years. The application to substitute Pamba Industries Limited as defendant was made after the limitation period had expired on 19th December 2003. Therefore, even if the judgment were set aside and substitution allowed, the intended suit against the proposed defendant would be time-barred. The court concluded that granting the orders sought would serve no purpose, as the claim against Pamba Industries Limited could not be sustained in law due to limitation. The application was dismissed for lack of merit.
