The court held that, pursuant to Rule 7 of the Auctioneers Rules, the judgment debtor is liable to pay the auctioneer's fees unless one of three exceptions applies: the debtor cannot be found, has no goods for execution, or the sale proceeds are insufficient. In this case, none of the exceptions were met. The execution was only conditionally stayed, and the warrants of attachment and sale were not set aside nor was any impropriety found on the part of the auctioneer. Therefore, the liability for auctioneer's fees remains with the judgment debtors, Kim Jong Kyu and Chon Jeum Suk Kim.
