Ratio Decidendi

The High Court found that only one charge sheet was present in the court file, which named both accused at the head but contained particulars only for the first accused in the body of the charge. There was no evidence of a second charge sheet relating to the second accused. The trial magistrate acted correctly in acquitting the second accused, as there was no charge against him in the charge sheet. Since there was no error apparent on the face of the record, there was no basis for the High Court to exercise its revisionary jurisdiction under section 364 of the Criminal Procedure Code. The file was ordered returned to the trial court for final orders.
