Ratio Decidendi

The court found that the applicant failed to comply with the mandatory procedural requirements under Rule 11 of the Advocates Remuneration Order. Specifically, the applicant did not serve the requisite notice on the Deputy Registrar within fourteen days of the taxation decision, nor did they properly file a reference or serve notice to other parties as required. While the court has discretion to enlarge time for filing a reference, such discretion is only exercisable where the applicant has demonstrated compliance with the preliminary procedural steps, which was not the case here. The application was therefore found to lack merit and was dismissed. No orders as to costs were made.
