Ratio Decidendi

The Court found that the respondent had commenced execution of the decree after extracting it, and that if execution were to proceed before the ruling on the main application for stay is delivered, the applicants' application and intended appeal could be rendered nugatory or academic. To prevent this and to serve the interests of justice, the Court determined that the appropriate order was to maintain the status quo as at the date of the ruling, pending delivery of the ruling on the main application for stay. The Court exercised its discretion to preserve the subject matter and ensure that its eventual decision on the main application would not be rendered futile.
