Ratio Decidendi

The court held that, according to Order 50 Rule 4 of the Civil Procedure Rules, the period between 21st December and 13th January is to be excluded when computing the time for filing an appeal. Applying this rule, the 30-day period for filing the appeal did not include the excluded days, and thus the deadline for filing the Memorandum of Appeal was extended. The Memorandum of Appeal, filed on 5th February 2015, was therefore within the prescribed time limit. The application to strike out the appeal for being out of time was found to be unmerited and was dismissed with costs to the respondent.
