On the limitation issue, the court held that although the suit was filed eight years after the cause of action arose, there was an application for leave to file out of time, and it was convinced that such leave was granted by the trial court. The court further held that there is no distinction between contractual and tortious claims under the Limitation of Actions Act regarding the court's power to extend time. As such, both grounds of appeal failed and the appeal was dismissed with costs.
