The High Court found that the respondent was indeed injured in the course of his employment while guarding fertilizer in the open field and that he was not provided with appropriate protective gear. However, the respondent also bore responsibility for his own safety, as the task did not require special training and he failed to keep a proper lookout. The court concluded that both parties were equally liable for the accident, apportioning liability at 50% each. The general damages awarded by the lower court were found to be excessive for the nature of the injuries, which were soft tissue injuries that healed completely.
