Civil Appeal / Judgment

  1. 1 Whether the respondent's retirement amounted to unfair and unlawful termination of employment.
  2. 2 Whether the remedies awarded by the trial court were legally sustainable.

Ratio Decidendi

The court found that the respondent's retirement did not amount to unfair or unlawful termination within the meaning of Sections 41, 43, and 45 of the Employment Act. The respondent was given more than the statutory minimum notice, and there was no evidence of a stipulated retirement age in the contract. The court held that the trial magistrate erred in finding the retirement substantively and procedurally unfair. The requirements for a hearing under Section 41 were inapplicable as the retirement was not based on misconduct or incapacity. The award of compensation to the respondent was therefore unsustainable, and the appeal was allowed, setting aside the trial court's judgment.
