Ratio Decidendi

The court found that there were irreconcilable inconsistencies regarding who was the highest bidder and purchaser at the auction of the suit property, raising a serious question as to the validity of the sale. Given the risk that completion and transfer of the property could place it beyond the court's reach before the substantive issues are determined, the court held that justice required maintenance of the status quo. The court therefore granted a stay of the sale and any dealings with the property pending the hearing and determination of the main suit, to prevent potential prejudice and legal complications should the sale later be found invalid.
