The tribunal found that the dispute between the parties was already the subject of pending proceedings in the High Court (Mombasa HCCC no E050 of 2023) and the subordinate court (SRMCC no E983 of 2023). The applicant failed to provide sufficient evidence that the High Court suit had been formally withdrawn, as there was no proof of receipt or order of withdrawal by the High Court. In the absence of such evidence, the tribunal held that it would be improper to continue entertaining the matter, as doing so would amount to forum shopping and risk conflicting decisions.
