Ratio Decidendi

The court found that the appellant failed to provide a truthful or satisfactory explanation for the delay in filing the appeal. The purported negotiations occurred well after the statutory period for appeal had lapsed, and no evidence was provided of any negotiations within the required 30 days. The delay was both inordinate and unexplained, and the appellant did not discharge the burden required to justify an extension of time. Consequently, there was no valid appeal before the court, and the application for stay of execution could not be considered. The Notice of Motion and the Memorandum of Appeal were therefore dismissed and struck out, respectively.
