The High Court found that although the sentence of 4 years imprisonment was within the statutory maximum for the offence of stealing by servant, it was manifestly harsh and excessive given that the appellant was a first offender and had already served a significant portion of the sentence. The court also noted the disparity in sentencing between the appellant and his co-accused, who received suspended sentences, which amounted to discrimination.
