Ratio Decidendi

The court held that the remedies of review and appeal are mutually exclusive alternatives. Once a party elects to pursue review under Order 45 Rule 1(a) Civil Procedure Rules and the review is determined, the right to appeal the same order is forfeited. The applicant, having chosen to seek review and lost, cannot subsequently seek extension of time to appeal the original judgment. Allowing both remedies would result in double allocation of judicial time and contravene the principles of efficient judicial resource use and finality of litigation. The application for extension of time and stay of execution was therefore dismissed.
