Ratio Decidendi

The court found that the plaintiff/applicant had established a prima facie case by providing a lease agreement and evidence of payment for the suit property. The defendant's evidence was insufficient, as the tenancy note did not describe the portion let and there was no proof of payment. The court held that there was a need to preserve the suit property to prevent prejudice to the plaintiff, who had paid for the portion in dispute. Accordingly, the court granted a temporary injunction restraining the defendant from dealing with the property pending the hearing and determination of the main suit.
