The court found that the plaintiff did not satisfy the requirements for adverse possession. Although the plaintiff had been in occupation of the suit land since 1981, his possession was initially by consent under a sale agreement. The agreement collapsed on 6th March 1986, and the defendant filed suit for eviction on 23rd September 1992, less than 12 years after the collapse. Therefore, the statutory period for adverse possession had not accrued by the time of the defendant's suit. The Court of Appeal had already determined that the plaintiff was in fundamental breach of the agreement and that limitation had not run in his favor.
