The Court of Appeal found that in six polling stations, voters were allowed to vote without proper identification by the KIEMS kit, contrary to the requirements of the Elections Act and the Constitution. The failure to capture voter data in the KIEMS kit, whether due to human error or otherwise, meant that ballots were not properly accounted for, undermining the principles of transparency, accuracy, and accountability. The subsequent recall of voters to scan their fingerprints after voting was not authorized by law and amounted to tampering with the KIEMS kit. The court held that these breaches were serious and sufficient to annul the results from the affected polling stations....
