The court held that, while rehabilitation and mitigation are important considerations in sentencing, the aggravating factors in this case—including the brutal assault, maiming, and infection of the complainant—outweighed the applicant's plea for a non-custodial sentence. The sentencing objectives of deterrence and community protection were paramount given the seriousness of the offence. The court found that the original sentence of 25 years was proportionate and just, but ordered that the sentence be computed from the date of first remand in accordance with Section 333(2) of the Criminal Procedure Code. The application for a non-custodial sentence was therefore declined.
