The delay was not inordinate, being approximately 30 days beyond the prescribed period, and there was no evidence of prejudice to the respondent if the extension was granted. The respondent's challenge to the applicant's advocates being on record was not supported by affidavit evidence and was therefore dismissed. The court exercised its discretion in favour of the applicant, allowing the application for extension of time to file the appeal.
