The proceedings were initiated under the Married Women’s Property Act, 1882, which, as interpreted by the Court of Appeal in Peter Ndung’u Njenga vs. Sophia Watiri Ndung’u, does not permit alienation or division of matrimonial property during coverture. The Matrimonial Property Act, 2013, which the applicant relied on in submissions, also does not apply retrospectively and similarly restricts division of property to situations where the marriage has been dissolved.
