Ratio Decidendi

The High Court lacks jurisdiction to deem a notice of appeal as withdrawn or to order the release of funds on the basis that no record of appeal has been filed. Such determination is exclusively within the province of the Court of Appeal under Rule 85 of the Court of Appeal Rules. The existence of a notice of appeal and a certificate of delay means the appeal process is still ongoing, and only the Court of Appeal can make a finding of withdrawal upon application or on its own motion. The application for release of funds is therefore not merited in the High Court. Costs follow the event, and since the respondent is successful, they are entitled to costs.
